Details
California court filing fees run to hundreds of dollars, and they are waivable. The waiver is a routine request, not a favour, and you qualify on any one of three separate grounds.
Three ways to qualify — you need only one
- You receive public benefits. Unemployment, Medi-Cal, CalFresh, WIC, CalWORKs, SSI/SSP or similar assistance qualifies you outright.
- Your household income is below the threshold listed on the application form.
- You cannot afford both basic household needs and the court fees at the same time.
The third ground is broader than people assume and does not require you to be receiving benefits.
The forms
According to the California Courts self-help centre, you file Form FW-001, Request to Waive Court Fees. The court responds on Form FW-003, Order on Court Fee Waiver.
What a waiver covers — and what it does not
A waiver may eliminate filing fees, first-paper response fees, the cost of certified copies, sheriff service fees, and the cost of a court reporter attending. It does not cover transcripts, lawyer fees, or fines.
So a waiver removes the cost of getting into court; it does not make litigation free.

The court can ask for the money later
A fee waiver is not always permanent. The court “may later decide you must pay some or all of the fees if your money situation gets better or you get money because of your case.” Winning a judgment can trigger that reassessment.
There is a protection attached: the court must tell you first and give you a chance to ask for a hearing. It cannot quietly bill you.
File it with your first papers
Submit the waiver request at the same time as the document you are filing, so the clerk can process both together. Filing the case first and asking about fees afterwards is what causes delays.
It applies across case types
Fee waivers are not limited to one kind of case — they are available in small claims, family law, civil matters and a name change petition, where the $435-$450 filing fee is often the main obstacle.
Income thresholds are revised periodically and appear on the current form. Check with the superior court where you are filing.
